Lawsuit Challenging FP&L Plant Revived in the Latest South Florida Business News
The Seminole Tribe of Florida has revived their lawsuit against Florida Power & Light’s proposed power plant in Hendry County. The controversy over the plant site has developed because it is close to tribe lands, panther habitat, and the need for the plant to draw large amounts of water from the ground in that location. On June 12, the Second District Court of Appeal ruled that FP&L and Hendry County were required to face the lawsuit, which challenges the rezoning of the site by the Hendry County Commission, and the case has been sent back to the 20th Judicial Circuit Court. The lawsuit was originally dismissed on the grounds that the site was governed by the Power Plant Site Act, but according to the appeals court, FP&L have not yet filed their application under that act.
